Who These Terms Are Between
These Terms of Service (“Terms”) form an agreement between Algebruh (“Algebruh”, “we”, “us”), a sole trader operating an online mathematics tutoring service, and the parent or legal guardian (“you”, “the Parent/Guardian”) who enrols a student (“the Student”) in Algebruh’s services.
Because Algebruh’s students are minors, the Parent/Guardian is the contracting party at all times. Students cannot enrol themselves, hold a billing account, or independently vary these Terms. Where these Terms refer to communication, consent, or agreement, that communication, consent, or agreement must come from the Parent/Guardian, not the Student.
By enrolling a Student, completing checkout, or otherwise engaging Algebruh’s services, you confirm that you are the Student’s parent or legal guardian and that you accept these Terms on the Student’s behalf.
Description of Services
Algebruh provides online mathematics tutoring, primarily for VCE Mathematical Methods and General Mathematics, delivered through:
- A weekly personal video component (recorded/live via Vimeo).
- A structured curriculum, either following the Student’s school pace/topics as directed by the Parent/Guardian, or, where no direction is given, Algebruh’s own default sequenced pathway for the Student’s year level (see section 8).
- A Google Classroom hub for ongoing questions, with a target response time of 1–2 business days.
- Weekly worksheets/materials and marked submissions, tracked via Algebruh’s internal progress record.
Algebruh is a supplementary tutoring service. It is not a school, is not affiliated with VCAA or any school the Student attends, and does not constitute official assessment.
Fees and Payment
- Tutoring is billed as a recurring weekly subscription via Stripe.
- Payment is processed automatically each billing cycle. You can manage your subscription (invoices, card details, cancellation, pausing) through a self-service billing portal linked from your account.
- Failed payment: if a scheduled payment fails, that week is treated as unpaid. No informal extensions or IOUs are offered, and no new content is issued for that week. Anything already delivered remains the Student’s, and nothing already provided is withdrawn for non-payment.
- No casual or one-off sessions: Algebruh does not offer single trial sessions. The first week of enrolment is delivered as the full standard weekly service.
- No sibling or referral discounts are offered. Pricing is set to be fair and competitive from the outset.
Cancellation and Pausing
You may cancel or pause the subscription at any time, with no lock-in contract, via the billing portal.
- If you cancel or pause, you will not be charged for the following billing cycle.
- No refunds are provided for a week in which content and services were delivered as normal, even if unused, since Algebruh’s obligation is to deliver the agreed material and support, not to guarantee engagement.
- Refunds are only appropriate where Algebruh has failed to deliver something it committed to provide for a paid week.
- Re-enrolment can occur at any time; a pause does not delete progress records or Classroom access history.
Non-Submission and Non-Engagement Policy
Algebruh understands that students occasionally miss a week. This policy exists to protect families from paying for a service that isn’t being used, while giving reasonable room for normal life to happen.
- One quiet week with no submission, on its own, is not treated as a problem and does not trigger escalation beyond Algebruh’s normal reminder process.
- If you let us know about a delay, the subscription and service continue as normal, because proactive communication, not submission itself, is what matters.
- If a week is fully silent (no submission and no communication), Algebruh follows a fixed escalation process: a light reminder to the Student around day 4; a direct reminder to the Parent/Guardian around day 6; and a final notice around day 7, with that week’s content delivered regardless.
- Only after a second consecutive fully silent week (no submission and no response anywhere in the process above) will the subscription be paused. A single silent week, or a silent week with any communication in between, will not result in a pause.
When a pause occurs, you will always be told why, framed as protecting you from paying for an unused service, not a silent cutoff. No records are deleted, and tutoring can resume whenever you’re ready.
Text/SMS Reminders
Where you have opted in, Algebruh may send SMS reminders to the Parent/Guardian’s contact number as part of the non-submission process described above. These are administrative/service messages related to your active subscription, not marketing communications, and can be withdrawn by contacting Algebruh directly.
Student Conduct and Use of Materials
Materials, worksheets, feedback, and recorded video content are provided for the personal educational use of the enrolled Student only, and may not be redistributed, resold, or shared outside the Student’s immediate household without Algebruh’s written permission. While core curriculum content may be shared in structure across students studying the same course, feedback, video sessions, and progress records are prepared individually for each Student.
Default Curriculum Pathway
Where a Parent/Guardian provides specific direction (a school’s pace, particular topics, or a target exam date), Algebruh will tailor the Student’s weekly content accordingly.
Where no direction is given, the Student is not left without a plan: they will automatically follow Algebruh’s own structured course for their year level. For VCE-level students, this pathway is aligned to VCAA’s published study design. For junior year levels (7–10), where no single external course applies uniformly across schools, the Student follows Algebruh’s own sequenced pathway rather than any specific school’s syllabus.
Academic Honesty
Algebruh’s services are intended to build the Student’s understanding and skills, and must not be used to complete or substantially assist with work that will be submitted for assessment by the Student’s school. This includes School-Assessed Coursework (SACs), graded assignments, take-home tasks, or examinations.
Where a Student requests help with content that appears to be current, in-progress assessed schoolwork, Algebruh may decline to provide direct answers and will instead focus support on the underlying concept, skill, or method. Parents/Guardians remain responsible for ensuring the Student’s use of Algebruh’s services complies with their school’s and VCAA’s academic integrity policies. Any exam-style or practice questions generated or adapted by Algebruh are reviewed and reworded to ensure they are Algebruh’s own original content, not reproductions of restricted assessment material.
No Guarantee of Academic Outcomes
Algebruh will make reasonable efforts to support the Student’s progress, but does not guarantee any particular grade, score, exam result, or study score. Academic outcomes depend on many factors outside Algebruh’s control, including the Student’s own engagement, attendance, and effort.
Qualifications, Insurance, and Liability
- Algebruh’s tutor holds current Victorian Institute of Teaching (VIT) registration.
- Algebruh does not currently hold professional indemnity or public liability insurance. This is disclosed so you can make an informed decision about enrolling.
- Marking and feedback provided by Algebruh reflect the tutor’s professional judgement and are not an official school or VCAA assessment, moderation, or certification.
- Other than any guarantee under the Australian Consumer Law that cannot lawfully be excluded, all other terms, guarantees, or warranties not expressly set out in these Terms are excluded to the extent permitted by law.
- Except where a loss results from Algebruh failing to meet a consumer guarantee under the Australian Consumer Law, Algebruh is not liable for indirect or consequential loss, including loss of opportunity, loss connected to an exam or assessment result, or any similar loss.
- To the maximum extent permitted by law, Algebruh’s liability for any loss arising from the services is limited to re-supplying the affected service or refunding the fees paid for the affected week, at Algebruh’s discretion.
Events Outside Our Control
Algebruh is not responsible for a delay or failure to deliver a session or materials where this is caused by something reasonably outside Algebruh’s control, for example an outage of a third-party platform Algebruh relies on (such as Google Classroom, Vimeo, or Stripe), illness, or another unforeseeable circumstance. Where this happens, Algebruh will reschedule or make up the affected content as soon as reasonably practicable, rather than treating it as a missed obligation.
Conflict of Interest
Students who are currently enrolled at, or otherwise connected to, the school at which Algebruh’s tutor is employed will not be accepted into the service, in order to maintain a clear and firm separation between Algebruh and the tutor’s employment. This exclusion applies without exception and is not assessed on a case-by-case basis.
Privacy
Algebruh’s collection, use, and storage of personal information (including any information about learning needs) is governed by Algebruh’s Privacy Framework. By enrolling, you acknowledge that Framework.
Severance
If any part of these Terms is found by a court or tribunal to be invalid, illegal, or unenforceable, that part will be treated as removed to the minimum extent necessary, and the remainder of these Terms will continue in full force and effect.
Changes to These Terms
Algebruh may update these Terms from time to time. Significant changes, including changes to fees, cancellation terms, or refund policy, will only take effect after you have been given written notice (for example, by email) in advance. Minor or administrative changes (for example, correcting contact details or clarifying existing wording) may be made without individual notice, and the updated Terms will be posted here.
Dispute Resolution
If a disagreement arises under these Terms, please raise it directly with Algebruh at support@algebruh.com.au first, so it can be resolved informally wherever possible. If it can’t be resolved that way, either party may refer the matter to the Victorian Small Business Commission for low-cost dispute resolution or mediation before starting court proceedings, except where urgent relief is genuinely needed.
Governing Law
These Terms are governed by the laws of Victoria, Australia, and any dispute arising from them will be subject to the jurisdiction of the courts of Victoria.
